Acceptance of Terms

By creating an account or using Feedbacker ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users — customers, vendors, and market managers.

The Service

Feedbacker is a review platform for farmers market vendors and customers. It allows customers to leave reviews for vendors, vendors to create public profiles, and market managers to manage their market listings.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

Accounts

  • You must provide a valid email address to create an account.
  • You are responsible for keeping your password secure.
  • You may not create an account on behalf of someone else without their permission.
  • One person or business may not hold multiple accounts to manipulate reviews.
  • You must be at least 13 years old to use the Service.

Reviews and User Content

When you submit a review or any other content to Feedbacker, you confirm that:

  • The review reflects your genuine, first-hand experience with the vendor.
  • You are not affiliated with the vendor or a competitor in a way that creates a conflict of interest.
  • The content is accurate to the best of your knowledge.
  • The content does not contain hate speech, harassment, or defamatory statements.
  • The content does not include personal information about private individuals.

You retain ownership of the content you submit. By submitting it, you grant Feedbacker a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content as part of the Service.

We reserve the right to remove any content that violates these terms or that we determine, at our sole discretion, is harmful to the platform or its users.

Vendor Listings

Vendors are responsible for ensuring their business information — including name, description, and market affiliations — is accurate. Feedbacker is not responsible for verifying vendor claims or the accuracy of vendor-provided information.

Feedbacker may create or maintain unclaimed listings for businesses based on publicly available information. Vendors may claim their listing by creating an account.

Premium Membership

  • Feedbacker Premium is a paid subscription for vendors at $10 per month.
  • Payment is processed securely by Stripe. By subscribing, you also agree to Stripe's terms of service.
  • Subscriptions automatically renew each month unless cancelled.
  • You may cancel at any time through your dashboard. Your Premium access continues until the end of the current billing period.
  • We do not offer refunds for partial months.
  • We reserve the right to change the price of Premium with 30 days' notice.

Prohibited Conduct

You agree not to:

  • Post fake, incentivised, or misleading reviews.
  • Attempt to manipulate ratings through coordinated review campaigns.
  • Harass, threaten, or intimidate other users or vendors.
  • Use the Service for any unlawful purpose.
  • Attempt to scrape, copy, or mirror the Service without permission.
  • Attempt to gain unauthorised access to any part of the Service.

Violation of these rules may result in immediate account suspension or termination.

Account Termination

You may delete your account at any time from your dashboard. Upon deletion, your personal information is removed and your reviews are anonymised.

We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or abuse the platform. We will make reasonable efforts to notify you before doing so except where immediate action is necessary.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not endorse any vendor, market, or review on the platform.

Limitation of Liability

To the fullest extent permitted by law, Feedbacker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Governing Law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
